WhiteVine Terms of Service

1. Purpose
These Terms of Service ("Terms") govern the use of the WhiteVine mobile application ("Service") provided by Nano Whitegrape ("Operator") and set out the rights and responsibilities of the Operator and users.
2. Definitions
For purposes of these Terms:
- "Service" means the WhiteVine mobile application and all features available through it.
- "User" means a person who agrees to these Terms and creates an account to use the Service.
- "Account" means the login credentials and identifiers used to identify a User and access the Service, including an email address, password, Sign in with Apple identifier, or similar authentication information.
- "Content" means information that a User posts, uploads, sends, or otherwise makes available through the Service, including text, images, audio, coordinate data, relationship information, tags, categories, and similar information.
3. Posting and Changes to Terms
- The Operator posts these Terms in the Service or through a linked screen so Users can easily review them.
- The Operator may revise these Terms as needed for legal compliance, service operation, security, policy changes, or changes to the Service.
- When the Operator revises these Terms, the Operator will provide reasonable prior notice of the effective date and reason for the revision through the Service, website, or another reasonable method. The Operator will generally provide at least 7 days' prior notice, and at least 30 days' prior notice for changes that materially affect Users in an adverse way, where reasonably practicable.
- If the Operator clearly notifies Users that continued use of the Service after the effective date will be treated as acceptance of the revised Terms, and a User does not object within the notice period, the User may be deemed to have accepted the revised Terms to the extent permitted by applicable law.
- If a User does not agree to revised Terms, the User may stop using the Service and delete the account. If the revised Terms are necessary for continued operation of the Service, the Operator may be unable to continue providing the Service to that User.
4. Account Registration
- An agreement to use the Service is formed when a person applies to register after agreeing to these Terms and the Operator accepts the registration.
- The Service is available only to persons who are at least 19 years old. If a User is found to be under 19, the Operator may suspend or terminate the Account. If the minor-user policy changes, the Operator will provide separate notice.
- The Operator may refuse or restrict registration if:
- the applicant previously had an Account terminated under these Terms;
- the applicant uses another person's name or identity;
- the applicant provides false or incomplete information or omits information requested by the Operator;
- the applicant is under 19;
- the application cannot reasonably be approved due to reasons attributable to the applicant, or the applicant otherwise violates these Terms or applicable requirements.
- The Operator may apply different usage limits, access levels, or service options where reasonably necessary to operate the Service.
5. Service Features and Changes
- The Operator provides the following features:
- a force-directed 3D social networking service;
- profile and post creation, viewing, and sharing;
- friend, block, report, and other social features, including the display and use of related activity information and statistics; and
- other services or features added by the Operator or provided through cooperation with third parties.
- The Operator may change, add, suspend, or discontinue features when necessary for stable service provision or operation, within the scope of applicable law and these Terms. Liability for damages outside the ordinary scope is governed by the disclaimers in Section 13.
- If the Operator changes material Service features or their availability under Section 5.2, the Operator will provide reasonable notice through the Service, website, or another reasonable method.
6. Service Suspension
- The Operator may temporarily suspend the Service for maintenance, inspection, system replacement, equipment failure, network interruption, security issues, or other substantial operational reasons.
- The Operator is not responsible for damages suffered by a User or third party due to temporary suspension under Section 6.1, except where caused by the Operator's intentional misconduct or gross negligence.
- If the Service can no longer be provided due to a change in business, discontinuation, merger, or similar reason, the Operator will notify Users in advance where reasonably practicable and may provide a separate process where needed.
7. User Information
- Users may view and edit their personal information through the account-management screen where the feature is available.
- If information submitted during registration changes, Users must update it online or notify the Operator of the change.
- The Operator is not responsible for issues caused by a User's failure to update information or notify the Operator of changes.
8. Account and Password Management
- Users are responsible for managing their Accounts and must not allow third parties to use them.
- The Operator may restrict use of an Account if the Account creates a personal-information security risk, is unlawful or offensive, violates public order or decency, or may be mistaken for the Operator or the Operator's staff.
- If a User becomes aware that the Account or password has been stolen or is being used by a third party, the User must promptly notify the Operator and follow the Operator's guidance.
- The Operator is not responsible for issues caused by a User's failure to notify the Operator under Section 8.3 or failure to follow the Operator's guidance after notification.
9. User Obligations and Prohibited Conduct
Users must not:
- provide false information when applying for registration or changing information;
- use another person's information or impersonate a person other than themselves;
- alter information posted by the Operator;
- infringe the intellectual property rights, including copyrights, of the Operator or any third party;
- harm the reputation of, or interfere with the business or operations of, the Operator or any third party;
- disclose or post obscene, violent, unlawful, harmful, or otherwise offensive messages, images, audio, or information through the Service;
- post or transmit information that promotes discrimination, hate, or hostility toward a specific person or group, or that constitutes threats or harassment;
- use automated means, including bots, crawlers, or scripts, to mass-create or mass-transmit Content or to access the Service in an abnormal manner ("Spam Conduct");
- stalk or otherwise harass another User;
- collect, store, or disclose another User's Account, password, personal information, or similar information;
- copy, distribute, or commercially use information obtained through the Service without the Operator's prior approval;
- intentionally interfere with operation of the Service or access the Operator's systems abnormally; or
- engage in any other conduct that the Operator reasonably determines violates applicable law, applicable rules, or these Terms.
In addition, Users must not post, upload, transmit, or otherwise make available:
- sexual content depicting minors or any content that sexualizes minors;
- content that encourages, glorifies, or provides specific instructions for self-harm or suicide;
- terrorist content or content that promotes violent extremism or recruits for terrorist organizations;
- non-consensual intimate imagery, including synthetic or AI-generated imagery; or
- the sale, trade, or facilitation of illegal drugs, weapons, counterfeit identification documents, or other unlawful goods or services.
The Operator may remove such content, restrict or terminate Accounts, and report applicable content to law enforcement or designated authorities where required or appropriate.
10. Content Management and Reports
- If the Operator determines that Content posted or made available through the Service violates Section 9, the Operator may take necessary measures, including temporary restriction, hiding, or deletion, without prior notice.
- Users may report Content that they believe violates Section 9 through the reporting feature.
- For reported Content in the following categories, the Operator automatically hides the Content from public view without additional review:
- sexual content; and
- violent content.
- Reports in other categories, including spam, impersonation, hate, harassment, and rights infringement, may be reviewed by the Operator before action is taken.
- The Operator may notify the reporter or posting User of the result of report handling or content-management action, and may limit the scope of notice to protect the privacy of the reporter and reported User.
- The Operator aims to provide an initial response to reports within a reasonable period, usually within 72 hours where operationally practicable.
- If a User objects to a content-management action, the User may contact the Operator using the method in Section 15. The Operator will review objections in good faith and may restore, maintain, or modify the action.
- Users who repeatedly submit reports that the Operator reasonably determines to be false, abusive, or made in bad faith may have reporting privileges limited.
11. Blocking
- Users may freely block other Users. Posts and activity of the blocked User are not shown to the blocking User, and posts and activity of the blocking User are not shown to the blocked User.
- A blocked User is not directly notified of the block. However, because access to both Users' Content is restricted, the blocked User may be able to infer that a block occurred.
- Users may unblock other Users at any time.
12. Content Rights and License
- Copyright in Content posted by a User in the Service belongs to that User.
- Users grant the Operator a non-exclusive, worldwide, royalty-free license to use Content for the following purposes. This license remains valid while the User's Account is active and ends when the Content is deleted or the Account is deleted, except to the extent continued processing is required by law or technically necessary for a limited period.
- providing, operating, and improving the Service;
- search, display, chronological feed, and cosmos visualization within the Service;
- statistics and analysis for service quality improvement and new feature development; and
- promotion of the Service, where the User has consented or where consent is not required by applicable law.
- If the Operator wishes to use a User's Content in a way not described in Section 12.2, the Operator will obtain the User's prior consent.
- When a User deletes an Account, Content created by that User is deleted from active Service systems without undue delay, except where retention is required by law or where limited related information must temporarily remain for technical, security, backup, or dispute-handling purposes.
13. Disclaimers
- The Operator is not responsible for failure to provide the Service due to natural disasters, force majeure events, or events outside the Operator's reasonable control.
- The Operator is not responsible for service disruptions caused by reasons attributable to a User.
- The Operator is not responsible for expected profits, business opportunities, or other benefits a User hoped to obtain through the Service. The Operator is not responsible for the reliability, accuracy, legality, or substance of Content posted by Users through the Service.
- The Operator is not responsible for disputes or transactions between Users or between a User and a third party through the Service.
- The Operator does not guarantee that the Service will be uninterrupted, error-free, or fit for a particular purpose. The Operator is not responsible for errors, data loss, or similar issues that may occur during use of the Service, except where caused by the Operator's intentional misconduct or gross negligence.
14. Account Deletion and Loss of Eligibility
- Users may request account deletion at any time through the account-deletion feature in the Service, and the Operator will process the request without undue delay.
- If a User requests account deletion, the User's Account, Content, comments, connection information, and similar information created by the User are deleted from active Service systems without undue delay. Some related records may be deleted together through database cascade deletion. However, information that must be retained under applicable law, security requirements, backup systems, or dispute-handling needs may be retained for the required or reasonably necessary period under the Privacy Policy.
- The Operator may restrict or suspend a User's Account if the User:
- provided false information when applying for registration;
- interferes with another person's use of the Service or misuses that person's information, thereby threatening the order of service use; or
- uses the Service to engage in conduct prohibited by applicable law, applicable rules, public order, standards of decency, or these Terms.
- If, after the Operator restricts or suspends an Account, the same conduct is repeated two or more times or the cause is not corrected within 30 days, the Operator may terminate the Account.
- Before restricting, suspending, or terminating an Account, the Operator will, where reasonably practicable, notify the User of the reason and effective date. The User may submit an objection within 14 days of notice.
- The Operator may take immediate action without prior notice when necessary to address serious legal, safety, security, or Service-operation risks, including content involving minors, credible threats, account compromise, or other imminent harm.
15. Contact and Dispute Handling
- The Operator maintains the following contact point to receive opinions, objections, reports, and complaints from Users.

- The Operator will review complaints and opinions submitted by Users in good faith and handle them within a reasonable scope. If handling requires additional time, the Operator may provide the User with an update.
- Where available and appropriate, disputes between the Operator and a User may be submitted to a mutually available consumer, electronic-commerce, platform, or online dispute-resolution process before formal legal proceedings.
16. Jurisdiction and Governing Principles
- These Terms are interpreted consistently with generally applicable contract, consumer-protection, platform, and privacy principles, without excluding mandatory protections that cannot be waived under the laws applicable to a User.
- Disputes between the Operator and a User will be handled by a court or other competent dispute-resolution body that has jurisdiction under applicable law, unless the Operator and the User agree to another lawful dispute-resolution method.
Supplementary Provisions
These Terms take effect on May 11, 2026.
The Operator may separately notify or revise parts of these Terms if changes to applicable requirements, Service content, or operation policy make such changes necessary.
These Terms are the English-language Terms for the Service.
Language Versions
These Terms may be made available in Korean and English. If there is any inconsistency between language versions, the version corresponding to the User's primary language of registration will generally apply. For Korean residents, the Korean version applies where required by Korean law. For all other Users, the English version applies. Where the law applicable to a User requires stronger mandatory protection, that mandatory protection applies regardless of language version.
iOS and App Store Platform Terms
If the Service is downloaded through Apple's App Store, the User acknowledges that these Terms are between the User and the Operator, not Apple. The Operator, not Apple, is responsible for the Service and its content, maintenance, support, and claims relating to the Service, except to the extent Apple has obligations that cannot be excluded under applicable platform terms or law.
The User receives a non-transferable right to use the Service on Apple-branded products that the User owns or controls, as permitted by the Apple Media Services Terms and Conditions and other applicable Apple usage rules. The User must also comply with applicable third-party terms when using the Service. Apple and its subsidiaries are third-party beneficiaries of this paragraph and may enforce it against the User after the User accepts these Terms.
